Residential vs. Commercial Construction: What's Actually Different

Most people assume residential and commercial construction are similar. They're not. Here's what actually differs — in codes, process, contracts, and what it takes to do each well.

The line between residential and commercial construction looks simple from the outside — one is houses, one is businesses. In practice, the two disciplines differ in meaningful ways that affect which contractors are capable of delivering each one well. This guide explains what's actually different.

Code: The Most Fundamental Difference

Residential construction in California is governed primarily by the California Residential Code (CRC), which is based on the International Residential Code (IRC). Commercial construction is governed by the California Building Code (CBC), based on the International Building Code (IBC).

These aren't just different books with similar rules. They reflect fundamentally different design philosophies:

Residential code focuses on occupant safety in smaller-scale, single-family dwellings. Requirements address structural loads (wind, seismic, gravity), fire separation between units, egress from sleeping rooms, and similar concerns.

Commercial code addresses higher-occupancy loads, longer means of egress, sprinkler system requirements, accessible design (ADA Title III), higher energy performance requirements (Title 24 nonresidential), fire-rated assembly requirements, and occupancy classifications that affect everything from floor area to exit width.

A contractor who builds excellent single-family homes doesn't automatically know how to navigate commercial code. The requirements for a restaurant vs. a medical office vs. a retail store vs. an office building are substantially different — each occupancy type has specific requirements for construction type, fire protection, plumbing fixture counts, and more.

Structural Requirements

Commercial buildings generally face higher structural demands:

Live loads: Commercial floors are designed for heavier loads than residential. An office floor is typically designed for 50–80 psf (pounds per square foot); a warehouse might be 125 psf or higher. Residential floors are often designed for 40 psf.

Seismic requirements in LA: Both residential and commercial construction in Los Angeles must meet California's seismic design requirements, but commercial buildings have more detailed requirements that scale with building occupancy, height, and use. An Importance Factor applies for higher-risk occupancies (hospitals, schools).

Materials: Commercial construction more frequently uses steel framing, concrete, or Type V light-wood framing with specific fire-rated assemblies, depending on occupancy and height. Residential construction is almost exclusively wood framing below 3 stories.

The Permitting and Plan Check Process

Commercial permitting involves more regulatory touchpoints:

Building permit: Required for essentially all commercial construction (unlike residential, where some minor work can proceed without permits).

Plan check process: Commercial projects at LADBS go through a more rigorous review that often involves multiple departments: Building, Fire, Planning, Public Works, and sometimes Zoning.

Fire department approval: The LA Fire Department reviews commercial plans separately for sprinkler systems, fire alarm systems, exit signs, and fire-rated construction. This adds time to the approval sequence.

Health department: Required for food service operations and some healthcare uses.

ADA review: Commercial projects are reviewed for ADA accessibility compliance — accessible entrances, restrooms, paths of travel, and service areas.

A commercial project in Los Angeles typically takes 3–6 months from permit submittal to approval, longer than most residential projects.

Contract Structure

Residential contracts tend to be simpler: a scope of work, a fixed price or GMP (Guaranteed Maximum Price), a payment schedule, and a warranty provision. California's contractor licensing law includes specific requirements for residential contracts (including the 10% deposit limit).

Commercial contracts are typically more complex:

  • Often use standardized AIA (American Institute of Architects) or EJCDC contract forms
  • May include bid bonds, payment bonds, and performance bonds
  • Typically require more detailed insurance provisions (higher limits, additional insureds)
  • Lien waiver requirements are more formal
  • Liquidated damages clauses (daily penalties for late completion) are common for commercial projects with hard occupancy deadlines

Labor and Workforce

In commercial construction, union labor is more common — particularly on projects over $5M or those with prevailing wage requirements (publicly funded or some publicly assisted projects). Prevailing wage rates in LA County for commercial construction trades are substantially higher than residential market rates.

Most small-to-medium commercial build-outs in LA use open-shop (non-union) contractors, which is appropriate for projects of that scale. But a contractor's workforce sourcing matters: commercial trades need specific experience with commercial-grade MEP systems, commercial door hardware, fire-rated assemblies, and ADA-compliant construction.

Schedule and Occupancy Pressure

Commercial projects often have a hard deadline that residential projects don't: the lease commencement date. A business has signed a lease, employees are being hired, a grand opening is being marketed — the space must be ready. Late delivery has real financial consequences.

This creates pressure that doesn't typically exist in residential construction. A good commercial contractor builds a schedule at the outset, identifies the critical path, and manages to it proactively. Delays on commercial projects don't just inconvenience the client — they can trigger lease obligations, lost revenue, and in some cases liquidated damages.

What a Good Contractor for Each Looks Like

Residential: Deep understanding of finish carpentry, tile, cabinetry, and the craftsmanship elements that define a quality home. Experience with the personal, relationship-intensive nature of working in someone's home. Detailed knowledge of permit requirements for the specific cities in their market.

Commercial: Understanding of commercial-grade MEP systems, fire-rated assemblies, ADA requirements, and commercial occupancy requirements. Experience managing schedule-driven projects with hard deadlines. Ability to work within occupied buildings with minimal disruption. Familiarity with the commercial plan check process.
